Users of any Testimonial Tree product or Service are not third-party beneficiaries to any contracts between us and independent contractors.

If another company acquires our company or assets, the acquiring company will possess your Personal Information collected by us and the acquiring company will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.

7. PROTECTING YOUR PERSONAL INFORMATION ACROSS BORDERS
Testimonial Tree complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Testimonial Tree has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF. Testimonial Tree has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. With respect to personal data received or transferred pursuant to the Data Privacy Framework, Testimonial Tree is subject to the regulatory and enforcement powers of the U.S. Federal Trade Commission.
Pursuant to the Data Privacy Framework, EU and Swiss individuals have the right to obtain our confirmation of whether we maintain personal information relating to you in the United States. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data transferred to the United States under Data Privacy Framework, should direct their query to info@testimonialtree.com. If requested to remove data, we will respond within a reasonable timeframe.
We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
In compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF), Testimonial Tree commits to resolve complaints about our collection or use of your personal information transferred to the U.S. pursuant to the EU-U.S. DPF, the UK extension to the EU-U.S. DPF, and the Swiss-U.S. DPF. EU, UK, and Swiss individuals with inquiries or complaints should first contact Testimonial Tree at info@testimonialtree.com.
Testimonial Tree has further committed to refer unresolved DPF Principles-related complaints to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbbprograms.org/dpf-complaints for more information and to file a complaint. This service is provided free of charge to you.

8. REGARDING MINORS
Our website is a general audience website with content directed primarily at individuals over the age of 18. Our website is not designed for minors under the age of 18. We do not intend to gather Personal Information from children under the age of 18 and we will delete any such information that becomes known to us.
9. LINKS TO OTHER SITES
Our provision of a link to any other website location, includes websites we have created for third parties, websites we host for third parties, websites linked to in our portfolio, and content or blog is for your convenience and does not signify our endorsement of such other website or location or its contents.
We have no control over, do not review, and cannot be responsible for these outside websites or their content. Please be aware that the terms of our Privacy Policy do not apply to these outside websites.
10. PRIVACY POLICY UPDATES
We may modify the provisions of this Privacy Policy at any time by posting a new version on this page and sending you written notice of such modifications. The new version will become effective on the date of such notice.
11. CHOICE OF LAW
If you choose to visit our website or use our products or services, any dispute over privacy is subject to this Privacy Policy as governed by the laws of the State of Florida. By using our Website, you agree that any dispute over privacy must be resolved only through arbitration or litigation. The sole venue for litigation is Lee County, Florida.

13. DATA DELETION REQUESTS
You have the right to request the deletion of your personal data that we have collected and stored. To submit a data deletion request, please follow these steps:
- Complete our Data Erasure Request Form, which can be obtained by emailing dp@testimonialtree.com or calling (239) 301-3517.
- Submit your completed form via email to dp@testimonialtree.com or mail it to our postal address: Address: 23150 Fashion Dr #242, Estero, FL 33928.
- Our Data Protection Team will review your request and may contact you for additional information if needed to verify your identity or process your request.
- We will process your request within one calendar month of receiving it, unless there are extenuating circumstances that require additional time.
- Once your data has been deleted, we will send you a confirmation.
Please note that we may be required to retain certain information for legal, regulatory, or security purposes. In such cases, we will inform you of the reason for retaining the data.
